Terms of Service

Draft for review. This is a working template that reflects how Gloam.fm intends to operate — it is not finished legal terms and not legal advice. Have it reviewed by counsel and localized before launch.

These Terms of Service ("Terms") are an agreement between you and Tiny Trash Labs LLC ("Gloam," "we," "us") governing your use of the Gloam.fm apps, websites, and services (together, the "Service"). Please read them carefully — by using the Service you agree to them.

01Agreement to these Terms

By creating an account or using the Service on the web, iOS, or Android, you agree to these Terms and to our Privacy Policy. If you're using Gloam on behalf of a household, business, or venue, you represent that you're authorized to accept these Terms on its behalf.

02Who can use Gloam

You must be at least the age of digital consent in your country (and meet the minimum age of the app stores and connected services) to use the Service. You're responsible for ensuring your use — and your guests' use at your events — complies with applicable laws and venue rules.

03What Gloam is (and isn't)

Gloam.fm is an AI DJ that sequences your music into a set, speaks on the mic in a chosen persona's voice, and takes live song requests, photos, and host announcements during a party. The Service plays audio through your own connected streaming account. Gloam does not host, license, sell, or distribute music, and is not a music-streaming service.

04Your account & security

You're responsible for your account, the accuracy of the information you provide, and all activity that happens under it. Keep your credentials and any admin / announcement QR links confidential — anyone with an admin link can send announcements to your party. Tell us promptly if you suspect unauthorized access.

05Connected services & bring-your-own streaming

The Service requires an active, supported streaming subscription — Spotify Premium or Apple Music — to play music, and connects to voice and AI providers to generate DJ speech. This is a technical requirement of those platforms, not an optional add-on. Your use of each connected service is governed by that provider's own terms, and music licensing remains entirely on your subscription.

06Free tier & live preview

Planning features — building playlists, resolving tracks, suggested set order, scheduling, and QR flyers — are free. Each account also gets a one-time 15-minute live preview with full AI voice at no charge so you can hear the Service before paying. We may change the scope of the free tier over time.

07DJ-hours, billing & the meter

Running a live party beyond the preview consumes prepaid DJ-hours, billed by the minute of actual party time (a 3.5-hour party costs 3.5 hours). You buy DJ-hours in bundles up front through our payment processor; pricing, quantity, and any expiry are shown at checkout. If your balance reaches zero mid-party, the AI voice mutes and your music keeps playing — the party isn't interrupted.

08Bring-your-own-keys unlock

You may purchase a one-time unlock to supply your own third-party API keys (e.g. voice and AI providers) and run live parties without consuming DJ-hours. If you do, you are solely responsible for those keys, for the charges they incur with the providers, and for complying with the providers' terms. We don't reimburse third-party usage costs.

09Refunds

Unused DJ-hours may be refundable for a limited period after purchase as described at checkout; hours already consumed are non-refundable because they incur real third-party costs. The one-time bring-your-own-keys unlock is non-refundable once used. Where local consumer law grants you stronger rights, those apply.

10Guest content & host responsibility

Guests can submit song requests, photos, and (with an admin link) announcements via a party's QR code. As the host you control the room: requests and announcements can be held, skipped, or cancelled, and you can delete any photo. You are responsible for the QR codes you distribute, who you give admin access to, and the content shown or played at your event. Don't collect guest photos or messages without appropriate notice and consent for your jurisdiction.

11Acceptable use

Don't use the Service to: broadcast unlawful, harassing, hateful, or infringing content; impersonate others or send announcements you aren't authorized to make; attempt to bypass the meter, security, or rate limits; reverse-engineer or resell the Service; or interfere with connected providers. We may suspend or remove content or accounts that violate these Terms or abuse connected services.

12AI-generated content

DJ speech and ordering suggestions are generated by AI and may be imperfect, unexpected, or factually wrong. Announcements are delivered in a persona's voice while preserving the facts you submit, but you remain responsible for the message you send. Don't rely on AI output for anything safety-critical.

13Intellectual property

The Service — including its software, branding, persona designs, and the Gloam.fm mark — is owned by Tiny Trash Labs and protected by law. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose. Music and other third-party content remain the property of their respective owners and your streaming provider.

14Disclaimers

The Service is provided "as is" and "as available." We don't warrant uninterrupted or error-free playback, the accuracy of AI-generated speech, or the continued availability of any third-party service (including Spotify, Apple Music, or voice/AI providers). To the maximum extent permitted by law, we disclaim all implied warranties.

15Limitation of liability

To the maximum extent permitted by law, Tiny Trash Labs will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Some jurisdictions don't allow these limits, so they may not fully apply to you.

16Suspension, termination & changes

You may stop using the Service and delete your account at any time. We may suspend or terminate access for violations of these Terms or to protect the Service. We may also modify or discontinue features, and we may update these Terms — we'll revise the date above and, for material changes, give reasonable notice. Continued use after an update means you accept the revised Terms.

17Governing law

These Terms are governed by the laws of the jurisdiction in which Tiny Trash Labs is established, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections in your country of residence. (Specific governing-law and dispute-resolution language to be finalized with counsel.)
